Description
In accordance with the Section 1-14 of the Concession Rules of the City of New York (Concession Rules), the New York City Department of Parks and Recreation (Parks) intends to enter into a negotiated concession for a license agreement for the operation, renovation, and maintenance of a restaurant and banquet facility at Clearview Park, Queens. The selected operator must be able to operate, renovate, and maintain the multi-level facility as a high-quality restaurant and banquet facility. The concession will have a term not to exceed twenty (20) years. The concession will be operated pursuant to a license issued by Parks. The concession is projected to commence early 2027 and will expire no more than twenty (20) years from the commencement date. As compensation to the City, Parks anticipates receiving a license fee, expressed as the greater of a guaranteed annual minimum fee versus a percentage of gross receipts. At this time, it is neither practical nor advantageous to award this concession by competitive sealed proposals or competitive sealed bids due to the existence of a time-sensitive situation as the existing concessionaire is repudiating their license agreement citing high labor and operational costs. Parks held off on amending the current license agreement to shorten the term and issuing a new RFP because the concessionaire expressed an interest in continuing operations under revised terms (new menu concept which didn't seem to work). Without a negotiated concession process, the facility will remain vacant while a new competitive solicitation will have to be conducted, which could take approximately a year to a year and a half from solicitation to award. During this time, Parks would be required to expend significant resources to maintain and secure the facility, while public service and concession revenue may be interrupted or lost.
